I suspect that, because they want people to support this, they have to keep it as simplified as possible, but this means leaving out the ifs, ands and buts. To me, the biggest problem is that the internet has been treated as a nigh untouchable entity, whether it be down to the lack of borders, or just that the existing laws that should have dealt with it, were challenged by those that go after the letter of the law (applying to physical media, as downloading did not exist, how could the law apply, etc).
One problem is that, should this gain traction, there will be groups that will attempt to use the declaration for their own agenda, which would derail the whole effort.
Another thing is that you are dealing with two sides that need to sit down and address the problem now, and the pre existing situation. The only thing is that the Ari Emmanuels need to be capable of saying ‘fair enough, let’s get this sorted’, and I don’t believe that they could be trusted to do so, and would be more likely to continue to insist that it is not their place to sort it out.
